New York Grandparents’ Rights Law: What DRL 72 Requires

New York Domestic Relations Law Section 72 establishes two types of relief a grandparent may seek: visitation and custody. These are distinct remedies with different legal burdens, and courts treat them accordingly.

Before a court considers whether a requested arrangement serves the child’s best interests, the grandparent must first establish legal standing to bring the petition. Standing isn’t automatic. New York courts recognize two pathways: one or both parents are deceased, or equitable circumstances exist that justify court involvement. Once standing is established, a separate hearing addresses whether the proposed visitation or custody arrangement is in the child’s best interests. A grandparent who can’t demonstrate standing doesn’t reach that second stage.

Custody petitions carry a higher burden than visitation petitions. In addition to establishing standing and satisfying the best-interests standard, a grandparent seeking custody must prove extraordinary circumstances, such as parental abandonment, neglect, or an extended period during which a parent voluntarily relinquished care of the child.
