In order to preserve a separate property character of these assets, they must never be co-mingled with marital assets. Transmutation by co-mingling can occur when separate and marital property become mixed together to such a degree that each cannot be identified and isolated for the purposes of classification, evaluation and distribution. When this happens, the separate property characterization of the particular asset is lost, and the co-mingled asset is transformed into 100% marital property. To avoid the danger of co-mingling, one might consider putting inherited funds in a trust.
