What Are the Grounds for Divorce in New York?

State law recognizes both no-fault and fault-based divorces. This means that either spouse can file for a divorce without first having to prove fault or wrongdoing, such as marital misconduct or infidelity.

A no-fault divorce can be sought on the grounds of “an irretrievable breakdown in relationship” for a period of at least 6 months. Fault-based grounds may include cruel and inhuman treatment, abandonment, imprisonment, adultery, and separation. 

What Are the Different Paths to Divorce?

There are two primary paths to divorce: contested and uncontested. 

An uncontested divorce is only available to couples who agree on every aspect of their divorce, including property division, child custody, spousal maintenance, child support, and other legally relevant issues. If both spouses cannot reach an agreement, they must file for a traditional contested divorce, which requires intervention from the court. 

While uncontested divorces are often less expensive and time-consuming, they are not recommended for couples with a high-net-worth, power imbalance, history of abuse or coercion, and complex assets or debts. In these cases, a contested divorce may be the best option for achieving a fair and legally sound resolution.
